The coach of BBC talent series The Voice and former *NSYNC star Justin are accused of copyright infringement in a new lawsuit filed on Wednesday at the US District Court of New York.
PK Music Performance claims the song, which featured on Justin’s FutureSex/LoveSounds album, is very similar to a Perry Kibble 1969 composition called A New Day Is Here At Last.
The suit says: “A substantial amount of the music in Damn Girl is copied from A New Day Is Here At Last” and names “a substantial part of the drum, conga drum, organ, bass guitar, electric quitter and saxophone parts” as being from A New Day Is Here At Last.
Perry was a co-producer, co-writer and keyboard player.
An original member of disco group A Taste Of Honey, his band enjoyed a UK hit with Boogie Oogie Oogie which peaked at number three in 1978.
